Terms & Conditions

These Terms & Conditions (“Terms”) govern access to and use of https://www.svaraonline.in (the “Website” / “Platform”) and all services, features, content, and purchases made through it (collectively, the “Services”). By accessing, browsing, or purchasing from the Platform, you agree to be bound by these Terms and our policies referenced herein.

 

1) Legal Status of This Document (Electronic Record) 

This document is an electronic record under the Information Technology Act, 2000 and rules thereunder. It is generated by a computer system and does not require physical or digital signatures.

3) Policies Incorporated by Reference 

These Terms incorporate the following policies (as updated from time to time), which form part of your agreement with us: 

  • Privacy Policy 

  • Shipping Policy 

  • Refund/Return Policy (if published as “Refund Policy”) 

  • Any product-specific terms shown at checkout or on product pages 

 

In case of conflict, the terms shown at checkout for your specific order (including refund/return conditions) will prevail for that order, to the extent permitted by law. 

4) Eligibility & User Responsibilities 

  1. You must be competent to contract under Indian law. If you are under 18, use the Platform only under supervision of a parent/guardian. 

  2. You agree to provide true, accurate, and complete information when placing an order or creating an account. 

  3. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. 

 

5) Account Registration (If Applicable) 

  • Creating an account is optional unless the Platform requires it for certain features. 

  • We may suspend or terminate accounts that provide false information, misuse coupons, attempt fraud, or violate these Terms. 

 

6) Products, Content Accuracy & Availability 

  1. We sell fragrance and related products (“Products”) through the Platform. 

  2. Product images are for representation. Actual color/packaging may vary due to lighting, device displays, batch variations, or upgrades. 

  3. We strive for accuracy, but we do not warrant that product descriptions, pricing, or availability information is error-free. We may correct errors and update information at any time. 

 

7) Orders, Acceptance & Cancellation 

  1. Placing an order constitutes an offer to purchase. An order is accepted only when we confirm dispatch/shipping and/or send an order confirmation as per our systems. 

  2. We reserve the right to refuse, cancel, or limit any order in cases including but not limited to: ○ suspected fraud or misuse, 

  • incorrect pricing/inventory errors, 

  • inability to fulfill due to operational issues, 

  • violation of these Terms. 

 

  3. If we cancel an order after payment, we will initiate a refund as per our Refund/Return Policy. 

 

8) Pricing, Taxes & Payment 

  1. Prices are listed in INR and may be inclusive/exclusive of taxes as displayed at checkout. 

  2. Delivery charges (if any) are shown at checkout. 

  3. Payments are processed by third-party payment gateways. We do not store complete card details/CVV/UPI PIN. Your use of third-party payment services is subject to their terms and privacy policies. 

  4. We may run promotions/coupons subject to additional conditions (validity, minimum cart value, non-combinability, one-time use, etc.). We may withdraw or modify offers at any time to the extent permitted by law. 

9) Shipping & Delivery 

Shipping timelines, serviceability, and delivery processes are governed by our Shipping Policy. 

  • Delivery timelines are estimates and may vary due to courier delays, force majeure, address issues, local restrictions, or peak volume. 

  • You are responsible for providing a complete and accurate delivery address and being available to receive the parcel. 

10) Returns, Refunds & Replacements 

Returns/refunds/replacements are governed by our Refund/Return Policy. 

  • Certain items (e.g., opened/used products, hygiene-sensitive goods) may be non-returnable except in cases of manufacturing defect/damage-in-transit, subject to applicable law and your published policy. 

  • If a return is approved, refunds are processed to the original payment method unless otherwise stated. 

11) Product Use & Safety Disclaimer (Important) 

1. Our Products are for external use only unless explicitly stated otherwise. 

2. Patch test recommended. Discontinue use if irritation occurs and consult a professional if needed. 

3. Information provided on the Platform (including wellness language, ingredient notes, or fragrance descriptions) is for general informational purposes and is not medical advice. 

4. Individual reactions vary depending on skin type, allergies, environment, and use. You are responsible for checking ingredients and suitability. 

 

12) Intellectual Property 

All content on the Platform, including text, graphics, logos, product names, images, design elements, and software, is owned by or licensed to Svara and protected by applicable intellectual property laws. 

  • You may not copy, reproduce, distribute, modify, publish, create derivative works from, or commercially exploit Platform content without prior written permission. 

 

13) Acceptable Use & Prohibited Conduct 

You agree not to: 

  • use the Platform for unlawful purposes; 

  • violate any applicable law or regulation; 

  • attempt unauthorized access to systems or data; 

  • upload malware, scrape data, or interfere with Platform operations; 

  • impersonate any person/entity or misrepresent affiliation; 

  • infringe IP rights or misuse Svara branding. 

 

14) Third-Party Links 

The Platform may contain links to third-party websites or services. We do not control and are not responsible for third-party content, terms, or privacy practices. Accessing third-party links is at your own risk. 

15) User Communications & Marketing 

By placing an order or submitting your contact details, you agree we may contact you about: 

  • order confirmations, shipping updates, service messages, and support; and 

  • marketing communications where permitted by law and/or based on your consent/preferences. You can opt out of marketing messages by following the unsubscribe method provided or contacting us. 

 

16) Disclaimer of Warranties 

To the maximum extent permitted by law: 

  • The Platform and Services are provided on an “as is” and “as available” basis. 

  • We disclaim warranties of uninterrupted availability, accuracy, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted under applicable law. 

 

17) Limitation of Liability 

To the maximum extent permitted by law: 

  1. Svara shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. 

  2. Our total liability for any claim relating to an order shall not exceed the amount paid by you for the specific product/order giving rise to the claim. 

  3. Nothing in these Terms limits liability that cannot be limited under law (including applicable consumer protection rights). 

 

18) Indemnity 

You agree to indemnify and hold harmless Svara, its affiliates, directors, officers, employees, and agents from any claim, loss, liability, expense, or demand (including reasonable legal fees) arising out of: 

  • your breach of these Terms/policies, 

  • your violation of law, 

  • your infringement of third-party rights, 

  • misuse of the Platform. 

 

19) Suspension & Termination 

We may suspend or terminate access to the Platform or Services (including cancelling orders, restricting accounts, or blocking access) if we reasonably believe you have violated these Terms, engaged in fraud, or created risk to the Platform or other users. 

20) Force Majeure 

We are not liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, acts of government, pandemics, internet outages, strikes, logistics disruptions, or payment network failures. 

 

21) Governing Law & Dispute Resolution 

  1. These Terms are governed by the laws of India. 

  2. Good-faith resolution: Parties will first attempt to resolve disputes amicably within 30 days of written notice. 

  3. Arbitration (recommended for enforceability & speed): If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. ○ Seat and venue: New Delhi, India 

○ Language: English 

○ Arbitrator: Sole arbitrator appointed mutually; failing which, appointed as per the Act.

23) Changes to These Terms 

We may modify these Terms from time to time. The updated Terms will be posted on this page with a revised “Last updated” date. Continued use of the Platform after updates constitutes acceptance of the revised Terms. 

24) Miscellaneous 

  • Severability: If any provision is held unenforceable, the remaining provisions continue in full force. 

  • Waiver: Failure to enforce any right does not constitute a waiver. 

  • Assignment: You may not assign your rights under these Terms. We may assign our rights/obligations as part of a business transfer. 

  • Entire Agreement: These Terms and incorporated policies constitute the entire agreement between you and Svara for use of the Platform.
